W3 Fair GmbH - General Terms and Conditions for Events

§ 1 Scope of application
‍(1) The following General Terms and Conditions for Visitors (hereinafter referred to as “General Terms and Conditions”) apply to participation in events organized by W3 Fair GmbH (hereinafter referred to as “W3 Fair”) and to all resulting contractual relationships between W3 Fair and the visitor. The Terms and Conditions are accepted upon purchase of a ticket or attendance at the event.
(2) W3 Fair does not recognize any terms and conditions of the visitor that deviate from or contradict these Event Terms and Conditions, unless W3 Fair has expressly agreed to a change in writing. Side agreements, in particular guarantees, changes, and additions, are only effective if W3 Fair expressly agrees to them. They must be made in writing for later verification.

‍§ 2 Organizer / Contractual Partner The organizer is W3 Fair. By purchasing a ticket, a contractual relationship regarding attendance at the event is established exclusively between the visitor and W3 Fair.

‍§ 3 Offers and Prices
‍(1) Offers and prices are always subject to change. Prices include statutory value added tax. Sales are made only in commercially available quantities.
(2) Tickets will not be exchanged or taken back by W3 Fair.
(3) Trading tickets for the event is strictly prohibited.

 

§ 4 Use of the online service
(1) The customer may only use the online service for private, non-commercial purposes. The use of automated technical means, such as scripts or macros, to monitor or manipulate the online service is prohibited by W3 Fair.
(2) The customer undertakes to keep all access data for the personalized area of the online access (customer account) confidential and to inform W3 Fair immediately if this data is no longer confidential. This also applies if the customer suspects or becomes aware that their access data has been misused. In any case, however, the customer remains responsible for the unauthorized use of the online offering. All declarations of intent made using their online access (customer account) or other access data are effective for and against the customer, unless the customer is not responsible for the misuse of their online access (customer account) because there has been no breach of existing duties of care.
(3) W3 Fair’s online offer for the purchase of tickets is aimed exclusively at end customers. The purchase of tickets for resale is prohibited.

§ 5 Conclusion of contract & right of withdrawal
(1) By clicking on the “Buy” button at the end of the ordering process, the customer submits a binding offer to conclude a contract for the purchase of tickets for W3 Fair events. W3 Fair reserves the right to reject the customer’s offer at any time without giving reasons. A legally binding contract is only concluded when the tickets are sent by email.
(2) When selling tickets for leisure events on a specific date, there is no right of withdrawal in accordance with § 312g (2) No. 9 BGB (German Civil Code). Every ticket order is therefore binding and obliges the customer to pay for the tickets ordered.

§ 6 Payment
(1) The total price of the order, including all fees, is payable by the customer immediately after conclusion of the contract (Section 5 (1)). Payment is made by credit card, PayPal, or direct debit from a German bank account when placing the order.
(2) If a return debit occurs in the direct debit procedure for which W3 Fair is not responsible, a fee of €15.00 will be charged, which the customer must pay in addition to the invoice amount. Unauthorized cancellations of credit card payments will be subject to a fee of €25.00. The customer must settle the return debit by bank transfer within one week of the return debit to the account of W3 Fair GmbH, Commerzbank IBAN: DE55200400000621577600.

§ 7 Shipping & Returns
(1) After payment, the tickets will be sent to the customer free of charge as a PDF document to the email address provided when ordering. The tickets must be printed out by the customer in A4 format or presented on a mobile device at the entrance to the event. In the case of tickets for online events, the customer will receive a link together with the ticket that allows them to access the online event (hereinafter referred to as the “access link”).
(2) The customer must ensure that no unauthorized persons come into possession of the tickets and that they are not printed multiple times or otherwise reproduced. In the case of online events, the customer must also ensure that the access link is not disclosed to unauthorized third parties and is not published for general access. In the event of duplication, the customer shall be liable to W3 Fair for any demonstrable damage incurred. In this case, W3 Fair reserves the right to block the customer and issue a virtual ban.
(3) Immediately upon receipt of the tickets, the customer is obliged to check them for correctness in terms of number and prices, date, time, event, and venue. Complaints about incorrect tickets must be made in writing to W3 Fair at tickets@w3-fair.com immediately upon receipt. The incorrectly issued tickets must be attached to the letter as an appendix.
(4) Tickets cannot be returned or refunded. The face value of the ticket will only be refunded if an event is canceled. In this case, the purchase price will be refunded within a maximum of 14 days after the date of the event. Any advance booking fees paid will not be refunded. Booked tickets must be returned by mail to W3 Fair Events GmbH, Zirkusweg 1, 20359 Hamburg.
(5) If the respective event does not take place or is postponed due to circumstances beyond the organizer’s control, such as force majeure and equivalent events, e.g., national mourning, weather conditions, strikes, or war, the organizer shall not be held responsible for any resulting losses or damages. In this case, tickets will not be refunded.
(6) Lost or destroyed tickets will not be replaced by W3 Fair.

§ 8 Image and sound recordings
‍(1) In the event that image and/or sound recordings are made during a performance by persons authorized by W3 Fair, visitors agree, upon entering the event premises, that they may be recorded in image and/or word and that the recordings may be published and used in connection with reporting on the event without any claim to remuneration.
(2) Image and sound recordings of the event may also be made for advertising purposes. The visitor grants W3 Fair simple, transferable licenses, unlimited in terms of time, location, and content, to use, edit, and exploit the recordings for the promotion of the event, including in subsequent years, in accordance with their right to their own image and any rights of use, ancillary copyrights, personal rights, or other rights that may arise.
(3) If the visitor does not agree to this, they must clearly and expressly declare this to W3 Fair or the persons authorized by W3 Fair.
(4) Further information on this can also be found in the “Information on data protection in the production and use of photos,” which can be viewed at the organizer’s premises.

 

§ 9 House rules / Terms of use
(1) By purchasing tickets and attending the event, visitors agree to abide by the house rules and terms of use of the respective event venue.
(2) In addition, the following terms of use apply:
· Bringing pyrotechnic items, torches, weapons, and weapon-like items onto the event grounds is strictly prohibited.
· The carrying of media recording devices may be restricted (including in certain areas of the event). This will be indicated by appropriate signs.
· The instructions of security and event staff must be followed.
· A security check will be carried out at the entrance. In order to ensure compliance with the security regulations, security personnel are authorized to carry out visual and manual checks of bags, clothing, and the body. W3 Fair reserves the right to refuse entry to persons who are intoxicated, aggressive, or dressed inappropriately for the event without refunding the admission price.
· Fire safety regulations and escape and rescue plans must be followed in case of danger
· All visitors are required to comply with and observe the German Youth Protection Act (JuSchG; see notices) and other relevant laws throughout the entire event site. Violations by third parties must be reported immediately to security personnel.
(3) W3 Fair has domiciliary rights within the scope of the event. In this respect, W3 Fair reserves the right to expel persons who violate the above regulations, commit criminal offenses (e.g., theft, drug dealing, assault, etc.) on the event grounds, and/or endanger third parties or the course of the event from the event without refunding the admission price and, if necessary, to file a criminal complaint.
(4) Wilful contamination of the event location will be punished with a flat-rate cleaning fee. The visitor is entitled to prove that W3 Fair has incurred no damage or only significantly less damage.

§ 10 Change of venue or date / Cancellation of the event
(1) W3 Fair reserves the right to change the venue and/or date of the event. W3 Fair will inform customers of this in good time by posting a notice on its website and, if necessary, by telephone, in writing, or by email. In this case, the customer has the right to withdraw if the change is unreasonable, which they can exercise by returning the tickets by mail to W3 Fair Events GmbH, Zirkusweg 1, 20359 Hamburg, Germany, before the start of the event. The customer will be refunded the face value of the ticket. A postponement is considered unreasonable if the new date or venue is unreasonable for the visitor, taking into account their legitimate interests. However, this does not apply if the cancellation or postponement is due to force majeure (see § 6, paragraph 5).

§ 11 Special provisions for online events
(1) The access link entitles only one person to participate in the online event. Passing on the link to third parties is prohibited.
(2) The use of services within the scope of online events is only permitted in accordance with applicable laws and taking into account the rights of third parties. The customer may not violate any legal prohibitions, morality, or the rights of third parties (copyright, trademark, and data protection rights, etc.) through the content and data provided by them. The online event may not be used for fraudulent activities or activities related to criminal offenses, harassment, or other inconveniences.
(3) W3 Fair reserves the right to delete data entered by customers, block user profiles, and block access to the online event or individual services provided free of charge without giving reasons. W3 Fair is particularly entitled to do so if the customer violates applicable law or the terms of use. The blocking of paid services is only permitted if there is an important reason.
(4) W3 Fair points out that, given the current state of technology, hardware and software errors cannot be completely ruled out. Therefore, no warranty can be given in this regard. Due to technically necessary maintenance work, 100% availability of the systems provided by W3 Fair cannot be guaranteed. The customer must notify W3 Fair immediately in writing or by email to tickets@w3-fair.com of any malfunctions or failures.
(5) The customer shall indemnify W3 Fair upon first request against all claims by third parties based on illegal or infringing content posted by the customer or other conduct of the customer. This applies in particular to copyright, trademark, name, data protection, and competition law infringements of any kind. The customer shall bear the costs incurred by W3 Fair for the necessary legal defense, including all court and attorney’s fees in the statutory amount, unless the customer is not responsible for the infringement.
(6) All content provided as part of the online event is the property of W3 Fair or the respective organizer/exhibitor and may be protected by copyright or other intellectual property rights. This content may not be used for any other purpose without the consent of the respective rights holders. In particular, it is prohibited to extract parts of the portal without the consent of W3 Fair and to use the data elsewhere, in particular in your own databases.

‍§ 12 Liability
‍(1) Visiting the event is always at your own risk. During performances and concerts, there may be a risk of hearing and health damage due to the volume.
(2) W3 Fair is only liable for damage to visitors without limitation if this is due to intentional or grossly negligent behavior on the part of W3 Fair. In the event of slightly negligent breaches of duty, W3 Fair shall only be liable in the event of a breach of essential contractual obligations or if W3 Fair has claimed trust in a special way. In this case, liability shall be limited to the direct damage to the visitor that is typical for the contract and foreseeable at the time of conclusion of the contract. This also applies to breaches of duty by legal representatives and/or vicarious agents of W3 Fair. Liability for injury to life, limb, or health remains unaffected.

§ 13 Final provisions
‍(1) Offsetting against claims by W3 Fair is only permissible with undisputed or legally established counterclaims. The assertion of rights of retention that are not based on the same contractual relationship is excluded.
(2) Should individual provisions of these terms and conditions be or become void, ineffective, and/or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions.
(3) The place of performance and payment is Hamburg. The law of the Federal Republic of Germany applies, with the exception of its provisions on private international law. The validity of the UN Convention on Contracts for the International Sale of Goods is excluded. This choice of law applies to consumers only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn. The exclusive place of jurisdiction for merchants, legal entities under public law or special funds under public law is Hamburg. However, W3 Fair is also entitled to bring legal action at any other legal place of jurisdiction.
